India military items not demilitarized in accord with Defense Department policy
counterfeit, replica, or pirated items; tickets or gift cards that restrict transfer
lottery or raffle tickets, sweepstakes entries, slot machines, gambling items
spam; miscategorized, overposted, cross-posted, or nonlocal content
postings or email the primary purpose of which is to drive traffic to a website
postings or email offering, promoting, or linking to unsolicited products or services
affiliate marketing; network, or mliti-level marketing; pyramid schemes
any good, service, or content that violates the law or legal rights of others

Avoiding Scams

Deal locally, face-to-face follow this one rule and avoid 99% of scam attempts.

Do not extend payment to anyone you have not met in person.
Beware offers involving shipping - deal with locals you can meet in person.
Never wire funds (e.g. Western Union) - anyone who asks you to is a scammer.
Don't accept cashier/certified checks or money orders - banks cash fakes, then hold you responsible.
Transactions are between users only, no third party provides a "guarantee".
Never give out financial info (bank account, social security, paypal account, etc).
Do not rent or purchase sight-unseen that amazing "deal" may not exist.
Refuse background/credit checks until you have met landlord/employer in person.

Who should I notify about fraud or scam attempts?

If you are defrauded by someone you met in person, contact your local police department.

If you suspect that a Cootera Classifieds post may be connected to a scam, please send us the details.

Recognizing scams

Most scams attempts involve one or more of the following:

Email or text from someone that is not local to your area.
Vague initial inquiry, e.g. asking about "the item." Poor grammar/spelling.
Western Union, Money Gram, cashier check, money order, paypal, shipping, escrow service, or a "guarantee."
Inability or refusal to meet face-to-face to complete the transaction.

Examples of Scams

Someone claims your transaction is guaranteed, that a buyer/seller is officially certified, OR that a third party of any kind will handle or provide protection for a payment:

These claims are fraudulent, as transactions are between users only.
The scammer will often send an official looking (but fake) email that appears to come from Cootera Classifieds or another third party, offering a guarantee, certifying a seller, or pretending to handle payments.

Distant person offers a genuine-looking (but fake) cashier's check:

You receive an email or text (examples below) offering to buy your item, pay for your services in advance, or rent your apartment, sight unseen and without meeting you in person.
A cashier's check is offered for your sale item as a deposit for an apartment or for your services.
Value of cashier's check often far exceeds your item scammer offers to "trust" you, and asks you to wire the balance via money transfer service.
Banks will cash fake checks AND THEN HOLD YOU RESPONSIBLE WHEN THE CHECK FAILS TO CLEAR, sometimes including criminal prosecution.
Scams often pretend to involve a 3rd party (shipping agent, business associate, etc.).

Someone requests wire service payment via Western Union or MoneyGram:

Deal often seems too good to be true, price is too low, or rent is below market, etc.
Scam "bait" items include apartments, laptops, TVs, cell phones, tickets, other high value items.
Scammer may (falsely) claim a confirmation code from you is needed before he can withdraw your money.
Common countries currently include: Nigeria, Romania, UK, Netherlands but could be anywhere.
Rental may be local, but owner is "travelling" or "relocating" and needs you to wire money abroad.
Scammer may pretend to be unable to speak by phone (scammers prefer to operate by text/email).

Distant person offers to send you a cashier's check or money order and then have you wire money:

This is ALWAYS a scam in our experience the cashier's check is FAKE.
Sometimes accompanies an offer of merchandise, sometimes not.
Scammer often asks for your name, address, etc. for printing on the fake check.
Deal often seems too good to be true.

Distant seller suggests use of an online escrow service:

Most online escrow sites are FRAUDULENT and operated by scammers.

Distant seller asks for a partial payment upfront, after which they will ship goods:

He says he trusts you with the partial payment.
He may say he has already shipped the goods.
Deal often sounds too good to be true.

Foreign company offers you a job receiving payments from customers, then wiring funds:

Foreign company may claim it is unable to receive payments from its customers directly.
You are typically offered a percentage of payments received.
This kind of "position" may be posted as a job, or offered to you via email.

Sellers and buyers are completely responsible for working out the sale and exchange of goods or services
Sellers and buyers are responsible in resolving any disputes that may arise from classifieds transactions. It is important to use care throughout your dealings with other users in Cootera.com. Cootera.com cannot and does not confirm each and every user-purported identity.
Sellers and buyers are responsible for researching and complying with any applicable laws, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.
Upon the completion of a sale, sellers and buyers are responsible for their own payment, shipping costs, applicable taxes and any other costs incurred by participating in Cootera.com classifieds.

Accessibility

Cootera.com is a classified ads website for India. Ads posted on Cootera.com must be in English, however translation on ads are permitted.

Cootera.com services are available to all of our users who can perform legally binding contracts under applicable law. By using or registering with Cootera.com, you agree to provide true and accurate information about yourself; including your current residency in India.

Additionally, we reserve the right to refuse access of our service to anyone at our sole discretion.

Account and Password

You are solely responsible for all activities within your account under your password. Password should be treated with care and should not be disclosed to anyone. You cannot use your password or anyone else's password for any unauthorized purpose. You indemnify Cootera.com and its staff from all claims and liabilities made by a third party resulting from all activities incurred within your account. Additionally, your account may not be transferred, assigned or sold to a third party.

Web Linking

Web Linking may be used to direct users of Cootera.com to an external website. Web Linking may not be used to direct users of Cootera.com to a porn, explicit adult content, hate, or a questionable content website (as determined by Cootera.com). As well, directing users to an external website for the purpose of soliciting information, scam or fraud is strictly prohibited. Violation of the afore-mentioned rules will result in the ad(s) being discarded or modified and the member being banned from Cootera.com at the discretion of Cootera.com.

Member

Verification of a member is only an indication of likelihood that a member's identity is correct. As user verification on the Internet is difficult, Cootera.com cannot and does not guarantee any member's identity. Attempt by any member to state or imply that Cootera.com has endorsed their products or integrity may result in immediate termination of the member's status and may include permanent suspension of access to Cootera.com. False claims or statements that Cootera.com provides some form of guarantee is deceptive and should be reported immediately as abuse.

Cootera.com will not be held liable in any manner for any losses incurred by a Buyer or Seller regardless of their status. In the case of illegal or otherwise deceptive activities, Cootera.com responsibility will be limited to investigation and barring of such access as quickly as possible and to the best of our abilities.

Service Fee

Cootera.com classified service is free, to both buyers and sellers.

Interference

You are prohibited from using a secondary account or a third party to interfere with the negotiation process with another buyer or seller.

You are prohibited from spamming our system and/or impose an unreasonably or disproportionately large load on our system. You may not put any material on Cootera.com that contains any viruses, trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information. You may not solicit Cootera.com users to post ads on other classifieds sites.

Selling

All sellers must:

Comply with applicable laws. You may not offer for sale, trade or adoption any items or services to buyers in a jurisdiction where the item, service, or terms of the sale violate applicable laws or regulations. You also may not offer for sale, trade or adoption any item or service that violates Cootera.com policies as described below in "Prohibited Items and Services."
Provide accurate and up-to-date information. You must accurately describe the item you are selling, trading or offering for adoption. You may not include any language in your ad, which may mislead potential buyers or cause your ad to be included in search results to which it is not responsive.
Avoid inappropriate ad content. You may not link to, post, or include advertisements for goods or other materials that: (a) describe items or services that you are not selling in Cootera.com, or (b) you do not have right to link to or include. You also may not include any content or images in your ad that are obscene, offensive, harmful to minors, invasive of anyone's privacy, or otherwise inappropriate.
Have the rights to and possession of item. You may not offer any item for sale, trade or adoption that is not in your possession, you do not have the right to sell or trade items that does not exist at the time of the ad.
Place item in the appropriate category. You must list your item in the MOST appropriate category. Cootera.com reserves the right to relocate an ad that is deemed to be in an inappropriate category.
Provide an honest representation of your item for sale and indicating if your item is used, refurbished or a replica of the original.

Buying

Buyers are free to browse through the classified ads on our site and need not register with us to buy or contact sellers.

Cootera.com does not associate itself with the negotiation process between buyers and sellers
Certain ads listed on Cootera.com may contain a web link where buyers are free to navigate to the linked website. Be advised, Cootera.com is not affiliated or responsible for the content of the linked website. Any action or activity by the buyer on the linked website is at his/her sole responsibility.

Fraud

You may not use or manipulate this service for any fraudulent activity or purpose, including but not limited to collecting payment from buyers and not providing the item or service purchased.

Prohibited items and Services

It is the responsibility of both the seller and the buyer to ensure that the items or services listed for sale, trade or adoption are appropriate for sale, trade or adoption under all applicable laws and regulations. You may not sell, trade or adopt the following items or services under any circumstances:

Any item or service that is harmful to minors, obscene, or otherwise objectionable.
Any item that infringes the rights of a third party, including items that violate copyrights, trademarks, publicity, or privacy rights of third parties.
Any item that is counterfeit or stolen, including, but not limited to, counterfeit currency, coins, stamps, and equipment used to produce them.
Any animal items that are subject to regulations or laws for the protection of live animals, including endangered species and domesticated animals, as well as any products made from or including any parts of an animal protected by law or regulation.
Any item that has been the subject of a product recall by the Indian government or any government agency, or product manufacturer including items containing hazardous substances without a warning label.
Individual contracts, services, and any item that is non-transferable.
Non-packaged food items and other food or beverage items sold in a manner inconsistent with federal, state/province, or legal regulations.
Any used goods not appropriate for resale for safety, health, or other reasons.
Any items that can be used to inflict bodily harm on others, such as firearms, bombs, ammunition, firearm parts, switchblade knives, fireworks, or any kind of weaponry.
Bulk email lists containing names, addresses, or other personal information.
Gaming items such as, slot machines, lottery tickets, raffle tickets, and sweepstakes entries.
Alcohol or tobacco products, prescription drugs, medical devices and non-prescription drugs that make treatment claims that require FDA approval.
Items or services related to identification such as, citizenship documents, birth certificates, police or other government insignia.
Human or animal parts, including blood, organs and bodily fluids.
Any other item or service that violates any applicable federal, state, or local law or regulation or which Cootera.com determines, in its sole discretion, is inappropriate for sale, trade or adoption through the services provided by Cootera.com.

Spam

Cootera.com encourages you to post ads in Cootera.com as long as they are not duplicates or other forms of spam, or otherwise inconsistent with the Cootera.com terms and conditions. Cootera.com may take action to delete classified ads and/or Cootera.com user accounts that we believe are misusing this service. Prohibited spam or otherwise impermissible marketing activities in Cootera.com may include, but are not limited to, the following:

Posting identical, near duplicate, or otherwise, variant listings for the same item/service
Posting identical ads in the same category and location.
Posting an ad with inappropriate links, titles, descriptions, or unauthorized use of content to which the person posting does not have rights.
Posting an ad for the sole purpose of collecting user information or raising money.
Posting an ad that contains unsolicited or unauthorized advertising or promotional materials. This may include an ad that instruct the user(s) to contact the person/company posting the ad for more information and then require the user to pay a fee for that information.
Posting a job ad that requires a monetary investment by the user at any time.
Posting an ad that requires a user to register before getting detailed information about the product or position.
Posting an ad through unauthorized robots (crawling software).
Soliciting a Cootera.com user to post an ad in another classifieds site.
Cootera.com users do not appreciate spam. Spamming gives you and your service a bad name and decreases the effectiveness of your ads. Cootera.com may take corrective action, at our discretion, when prohibited activities or other misuses of the service become apparent.

Junk Ads

At Cootera.com, we offer free classified listings. This does not mean that we accept spam or junk ads that are not only unwanted, but are also rarely viewed. Our classified ads have value; hence, they are for serious buyers and sellers. Your ad should genuinely reveal your item or service; this creates trust on your part and it will only assist you in the sale of your product.

Cootera.com reserves the right to reject an ad or even ban a member who does not adhere to our user agreement in order to help safeguard our community of buyers and sellers. Please see "prohibited items/services" and "spam".
In addition, classified ads for, containing, or linking to the following will not be accepted:

* Explicit adult products or services
* "Income Guarantees", "Get-Rich-Quick Schemes", or unrealistic claims
* Chain marketing
* Stuffing envelopes, ad typing, or similar ventures
* Pyramids or binary schemes

Indemnity

You agree to defend, indemnify and hold Cootera.com and its officers, directors and employees harmless from and against any and all claims made by or liabilities to any third party resulting from any activities conducted under your membership or your use or misuse of our services.
